TikTok is facing a critical moment as the threat of a US ban looms. However, a glimmer of hope has emerged as the US Supreme Court has agreed to hear TikTok’s case against the impending ban. Here are the details.
US Supreme Court to Review TikTok’s Challenge on January 10
According to legislation enacted by the US Congress and signed by President Biden, TikTok is poised to face a ban in the US unless ByteDance divests its interest in the social media platform.
Until now, various legal attempts by ByteDance have not succeeded.
However, the last legal recourse to prevent the ban involves the US Supreme Court.
Today, the Supreme Court officially agreed to consider the case on Friday, January 10, 2025.
The oral arguments will be allocated a total of two hours for TikTok and its opponents.
Both parties are also required to meet specific deadlines prior to the hearing.
According to the Supreme Court’s notice:
The parties are directed to electronically submit simultaneous opening briefs, limited to 13,000 words, along with a joint appendix by 5 p.m. (EST), Friday, December 27, 2024. Reply briefs, capped at 6,000 words, must also be electronically filed by 5 p.m. (EST), Friday, January 3, 2025. Any amicus curiae briefs are to be filed electronically by 5 p.m. (EST), Friday, December 27, 2024.
The January 10 hearing does not leave much time before the January 19 deadline.
While there’s a possibility that the Supreme Court may expedite its decision after the January 10 hearing, it is uncommon for a ruling to be issued almost immediately.
Another consideration is President-elect Donald Trump, who has suggested that he may seek to reverse the ban if he can. His inauguration takes place the day after the January 19 deadline.
